Terms of service.
These terms govern the use of playwestbets.com and any related services operated by PLAYWEST PTY LTD. By opening an account or placing a wager you agree to be bound by these terms.
Eligibility
Wagering services are restricted to persons who are at least 18 years of age, who are physically located in Australia, and whose participation is not prohibited by any law applicable to the customer.
Account opening and identity verification
An account holder must complete identity verification under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) before any wager is accepted. playwestbets may request additional documentation at any time and may suspend account activity pending the outcome of that verification.
Before an account is opened, and on an ongoing basis, the applicant is checked against the National Self-Exclusion Register (BetStop), maintained under Part 7B of the Interactive Gambling Act 2001 (Cth) (as inserted by the Interactive Gambling Amendment (National Self-Exclusion Register) Act 2019 (Cth)). An account cannot be opened for, or accessed by, a person registered with BetStop for the duration of their registration. See Self-exclusion and BetStop.
Customer's responsibilities
By holding an account, the customer agrees that they:
- are at least 18 years of age, physically located in Australia, and not prohibited from wagering by any applicable law;
- open and operate only one account, in their own legal name, and do not allow any other person to access it;
- provide true, current and complete identity and contact information and keep it up to date;
- keep their credentials and multi-factor authentication confidential and notify playwestbets of any suspected unauthorised access;
- fund the account only from payment instruments held in their own name;
- do not engage in fraud, collusion, the use of automated tools, or any conduct that compromises the integrity of a market or event; and
- use the responsible wagering tools provided and wager only what they can afford to lose.
Wager acceptance
A wager is accepted only when displayed as confirmed inside the account. The trading desk may decline, cancel, or void any wager at its discretion in accordance with the rules published with the relevant market.
Payments
Deposits are accepted by eligible debit-card payments, BPay, PayID, Apple Pay and Google Pay where linked to an eligible debit card. Cryptocurrency, consumer credit cards (including BNPL) and third-party payment instruments are not accepted. Funding via consumer credit is restricted under the Interactive Gambling Amendment (Credit and Other Measures) Act 2023 (Cth), which amended the Interactive Gambling Act 2001 (Cth) to prohibit Australian-licensed wagering operators from accepting consumer credit card payments and certain related credit-derived payment instruments.
Withdrawals
Withdrawals are processed subject to identity verification, payment screening, AML/CTF checks and standard business-day banking schedules. Processing times vary by payment instrument and by the time of submission. No withdrawal fees apply.
Withdrawals are processed to a verified payment method in the customer's name. Withdrawals to third-party accounts are not permitted. Where the original deposit method cannot accept a withdrawal, an alternative verified method in the customer's name is used.
Funds protection
Customer funds are held separately from operating funds. In accordance with the conditions of the Victorian Gambling and Casino Control Commission licence, money held to the credit of customer accounts is segregated from the operating funds of PLAYWEST PTY LTD.
Settlement rules
Markets referenced on the Sports and Racing pages are settled by the trading desk on the official result declared by the relevant controlling body or principal racing authority.
- Head-to-head and match markets settle on the official full-time result, including any scheduled overtime unless the market states otherwise.
- Racing win and place markets settle on the official placings, subject to protests, scratchings and the applicable deductions.
- Futures and outright markets settle on the official outcome of the relevant competition.
- Abandoned, postponed or materially altered events are settled or refunded in accordance with the published market rules.
- Where an obvious pricing or palpable error is identified, the affected wager may be voided and stakes refunded.
Limits on stakes and maximum payouts
playwestbets may set or vary maximum stake amounts and maximum payouts per wager, per market or per customer, on a risk basis and in accordance with the rules published with each market. A wager is accepted only up to any applicable limit in force at the time of acceptance.
Anti-fraud and collusion
playwestbets may withhold, void or recover the proceeds of any wager affected by fraud, collusion, market manipulation, the use of prohibited automated tools, multiple-account abuse, or any breach of these terms. Suspected integrity matters may be reported to the relevant sporting or racing controlling body, to Sport Integrity Australia and to law enforcement.
Integrity and race-fields agreements
playwestbets operates under race-fields agreements with the relevant Australian principal racing authorities and pays the applicable race-fields fees. playwestbets cooperates with sporting and racing controlling bodies and with Sport Integrity Australia under the applicable integrity frameworks, including the sharing of wagering and account information where required to protect the integrity of sport and racing.
Promotions and inducements
playwestbets does not offer inducements to open an account. Any account-holder benefits available from time to time are conditional on the rules each State and Territory permits and are governed by the specific terms published with the offer. Inducements are not offered to customers in New South Wales or other jurisdictions where such offers are prohibited.
Inactive and dormant accounts
An account with no log-in or wagering activity for an extended period may be classified as inactive and subsequently dormant. playwestbets may contact the customer, suspend access pending re-verification, and deal with any remaining balance in accordance with applicable law, including any requirements relating to unclaimed money. Records are retained for the period required by the AML/CTF Act 2006 (Cth).
Termination and account closure
A customer may close their account at any time by contacting support@playwestbets.com. playwestbets may suspend or close an account for breach of these terms, on regulatory or AML/CTF grounds, on a risk basis, or following BetStop registration. On closure, open bets are settled or voided in accordance with the market rules, and any remaining balance is returned to a verified payment method in the customer's name after completion of all checks.
Use of customer data
playwestbets collects, holds, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. The categories of information collected, the purposes of use, disclosures to third parties, data retention and access and correction rights are set out in the Privacy Policy, which forms part of these terms.
Taxation
Wagering winnings are generally not subject to Australian income tax for recreational customers. Customers are responsible for assessing the tax treatment of their wagering activity in their own circumstances.
Variations to these terms
playwestbets may vary these terms from time to time. The current version is published at playwestbets.com. Material changes will be notified by reasonable means. Continued use of the account after a change takes effect constitutes acceptance of the varied terms.
Limitation of liability
To the maximum extent permitted by law, playwestbets is not liable for indirect or consequential loss arising from the use of the service, for events outside its reasonable control, or for losses arising from a customer's wagering. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Dispute resolution
Complaints are handled in accordance with the Complaints and dispute resolution policy: a matter is first raised with playwestbets for internal review, and may then be escalated to the relevant external body (including the VGCCC, OAIC, ACMA or AFCA where eligible).
Responsible wagering
playwestbets encourages customers to use the responsible wagering tools provided and to avoid wagering more than they can afford to lose. See Responsible wagering, Deposit limits, and Self-exclusion and BetStop.
Governing law
These terms are governed by the laws of Victoria, Australia. The customer submits to the non-exclusive jurisdiction of the courts of Victoria.
